Veteran Gaming Regulator Calls for Uniform Rules to Protect Young Adults
States should set standard minimum ages to participate in various forms of gambling, such as purchasing lottery tickets or entering casinos, according to an experienced gaming regulator who managed one of the biggest gambling markets in the nation.
After over 13 years as the director of the New Jersey Division of Gaming Enforcement (DGE), David Rebuck announced his retirement in March. Rebuck oversaw the enforcement of the state's Casino Control Act, which established the regulations governing the nine casinos in Atlantic City, in his capacity as director of the gaming regulatory agency.
Rebuck claims that New Jersey has to update its gambling rules since many of them were passed decades ago and are now out of date in the digital age, when billions of dollars are wagered annually online.
Rebuck thinks it is critically important to address the appeal of sports betting to young individuals.
According to the previous head of DGE, the appeal of sports betting has also helped to mainstream gambling in general. Rebuck proposes that in order to bring New Jersey's minimum age requirements for daily fantasy sports and lottery products into compliance with those for entering a casino, placing a sports wager, and using a regulated iGaming platform, the state should raise them from 18 to 21.
Uniform Age
Because fantasy sports are viewed as a game of skill rather than chance in New Jersey, they are not subject to the Casino Control Act's regulations. The New Jersey gaming legislation does not apply to contentious "skill" games, internet sweepstakes, or social casinos where real money cannot be earned.
According to Rebuck, the channels serve as entry points for addiction and gambling. He feels it would be sensible to restrict young adults from getting their feet wet for three more years to offer adequate time for those 18 to 21-year-olds to better comprehend the risks involved with the state’s multiple gaming outlets.
"Revising the age sends a powerful message that all gambling is an adult privilege. For some youth, gambling results in at-risk behavior with damaging lifelong consequences,” Rebuck wrote in a regulatory essay.
“Minors and 18 to 21 years old will undeniably benefit from the extra time to fully understand and prepare for any form of legal gambling engagement in the future,” Rebuck continued.
The Growth of Online Gaming
Online gaming continues to thrive in the Garden State.
In 2023, distant gamblers lost $1.92 billion to online slot machines and table games—a record amount for New Jersey's online casinos. iGaming's gaming revenue for the first eight months of 2024 has increased by 23% to exceed $1.52 billion.
With $482.7 million in sales from online gaming in 2019, it is clear that the industry has increased 300% in only five years.
The growth of sports betting is also ongoing. In 2023, oddsmakers made history by winning over $1 billion, a 32% increase from the previous year. Almost 20% more money has been kept by oddsmakers after eight months this year ($715.8 million) than through the same period last year.
With revenue from sports betting coming in at just under $300 million in 2019, it has increased by 233% in just five years.
Rebuck is against a federal plan that was just submitted to Congress and would impose rules on states that allow legal sports betting. One of the proposed criteria is to outlaw any advertising related to sports betting during live sports programming and between the hours of 8 a.m. and 10 p.m.
Rebuck thinks that the people best qualified to customize gambling legislation are state regulators, not legislators.
“It’s mind-boggling to me the arrogance of saying ‘we know more than you do,'” Rebuck commented.
